Why Bias Changes Criminal Law
A hate crime is not actually a distinct legal offense on its own. Instead, it is a standard crime like assault or vandalism that triggers harsher penalties simply because the victim was targeted for who they are.
The law effectively views the motive of prejudice as an aggravating factor that increases the severity of the punishment. By targeting a person based on their identity, the offender does more than harm one individual; they signal threat to an entire group. This legal framework aims to protect social cohesion by recognizing that biased violence carries a unique psychological weight. It is a powerful way for systems to distinguish between random acts of crime and those fueled by collective intolerance.
